Assaults journalist is in dire need of money for his treatment



Nimesh Rai is facing terrible pain and doctor advised for four expense injection with cost of each injection is 8,000 Rupees. Therefore PVCHR with joint support of RCT is providing medical support of 16,000 Rupees to him.

Working Group on Communications of the HRC has taken up Nimesh Rai case as G/SO 215/1 IND 26 (13. Dec. 2007) India to consider whether the facts of the case would divulge consistant pattern of gross human rights violation in India under the complaints procedure of the Human Rights Council.

Open letter to member of Rajya sabha on Prevention of Torture Bill, 2010

Respected Madam/Sir

 

SUB: Prevention of Torture Bill, 2010

 

People's Vigilance Committee on Human Rights (PVCHR) congratulates you and your party for passing The Prevention of Torture Bill, 2010 in the lower house of the Parliament during the Monsoon session, 2010.  This also testifies your commitment for the right to live in dignity for the common man. This bill has generated some hope among the dalits, tribals and other marginalized and poorer sections of the society including women and children who are victims of torture at the hand of the state or due to the nexus between state and private perpetrators.

 

The sense of victimhood coupled with denial of justice always alienates people from the process of nation building. Recently, a study has projected the number of torture cases in India per year at 1.3 million. The present bill will empower the victims.

 

However, among the prominent omissions in the bill are (1) It attempts to protect the public servant who are accused of committing torture, (2) Psychological torture must be included in the definition of torture and (3) The victims of torture must have Right to Rehabilitation. 

 

Madam/Sir, PVCHR with research support from Rehabilitation and Research Centre for Torture Victims RCT has analysed compatibility between The Prevention of Torture Bill in its present form and UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT). It has also proposed the desirables to be included in the present bill for making it more human and used for protecting the right to life with dignity of your countryman.

Stray bullets coming from 39 Gorkha Training Centre plague villagers


The stray bullet menace from the firing range of 39 Gorkha Training Centre (GTC), Varanasi continues to create havoc in adjoining villages like Pissure, Danialpur, Bhagwanpur, Kadipur, Indupur etc, following recent incident in Pissure village under Shivpur Police Station.

 

According to Haricharan, a resident from Pissure village, on 25 August 2010 at around 3 pm a bullet coming from firing range of 39 GTC hit his daughter Suman aged about 14 years old on her chest, while the victim was playing at her door. According to Haricharan there were other bullets came from firing range of 39 GTC, Two bullets, close to his house, have been found and collecte by him.

 

According to Haricharn, next day on 26 August, he took his daughter to a private hospital for X-ray. After the X-ray the bullet was found trapped inside the victim's chest and the incident was reported to the Shivpur Police Station on the same day in the afternoon. After registering an FIR regarding the incident, the police of Shivpur Police Station took the girl to Dindayal hospital, Pandeypur, Varanasi and got her admitted in the hospital for the medical treatment. Today at around 11.30 am after an operation the bullet was removed from the victim's chest but it would be too early to suppose that the girl is out of danger.

 

Peoples Vigilance Committee on Human Rights (PVCHR), a local NGO has reported that the cases of stray bullets from the firing range of the 39 GTC have been causing grave injuries and deaths to villagers and cattle for over last 25 years, despite that fact that these villages fall far away from the declared acquired range of the Army. The chronology of stray bullets incidents is attached with this write up.

 

It ironic to note that each time the GTC authorities have denied the incidents alleging that no report has ever been lodged with the police. The police on the other hand has showed each time after an incident of stray bullet indifferent attitudes as far as the remedy to a victim is concerned.

 

The Villagers has made several time representations to the Commissioner of  Varanasi Division, ADM (City) Varanasi, District Magistrate Varanasi and other officials regarding the incidents of stray bullets coming from firing range of 39 GTC to ensure their security .Even the then Sub Divisional Magistrate Mr. Yogeswar Ram Mishra conducted a survey and admitted in his report on January 27, 1996 that stray bullet from the firing range of 39 GTC had caused injuries to some villagers in 1994 and 1995 and suggested some security measures to prevent the stray bullets incidents, but no measure was taken to protect the villagers because of apathetic attitude of the GTC administration.

Dr. Lenin Raghuvanshi Executive Director, Peoples' Vigilance Committee on Human Rights (PVCHR)/Jan Mitra Nyas is going for indefinite hunger strike from 25th August, 2010 in front of UCO Bank, Pandeypur, Varanasi India due to the mental and financial harassment after twice return back of grant from the Danish organization Rehabilitation and Research Centre for Torture Victims (RCT) for the project "Promoting Psycho-legal support to reduce TOV in India".

Dr. Raghuvanshi has decided after not getting any appropriate solution and answers on the several email sent to the concerned bank (UCO Bank, Hong Kong and Shanghai Banking Corporation, HSBC). One hand UCO Bank stated the grant is lying in the HSBC bank and RCT informed that grant has return back. The matter was even taken up to the Reserve Bank of India, Prime Minister of India, Mr. Rahul Gandhi and Ms. Sonia Gandhi.

·        On 27th July, 2010 RCT transferred first installment of 250,000 DKK and it was return back. On 10th August, 2010 Zonal Office, UCO Bank wrote letter to HSBC for the transfer of the fund

·        Again the same grant was transferred on 10th August, 2010 on the request of its partner organization JMN, we immediately informed to the UCO Bank & HSBC for tracing and transfer of fund, but unfortunately RCT informed that grant return back from UCO Bank, Pandeypur. Now on 18th August, 2010 the Zonal Office informed that Treasury Branch need MT-103 to trace the fund. It is a type of harassment of the customer.

 

Prior to this JMN/PVCHR and RCT successfully hold three pilot project "Capacity building for testimonial therapy in India" the grant was transferred through the same process. During that time only one time grant was return back to them.

It is very pathetic that staffs/consultants are working and not remunerated with any single penny and the activities of the project have also started. The organization is not in the financial conditional to easily face such condition.

Satyagrah of Mahatma Gandhi is the way to seek the truth so, he is going for hunger strike to remember father of nation.

Therefore it is kind request please provide support to Dr. Lenin Raghuvanshi
