These proceedings shall be read in
continuation of the earlier proceedings of the Commission dated 03.02.2017
where the Commission inter-alia observed and directed as under: “The
complainant has alleged that leg of a nine-year old boy had to be amputated
because of the negligence of the Ward Boy of District Hospital of Varanasi. Posing
himself as the doctor he performed the surgery on the victim boy. In response
to the Commission's directions, a report dated 08.03.2016 has been received
from the Special Secretary, Government of Uttar Pradesh. It is reported that
a three-member committee was constituted to enquire into the matter. The Ward
Boy was, prima-facie, found responsible for the incident and he has been
suspended. The Commission has considered the report. The nine-year old boy
has been permanently disabled because of the negligence on the part of the
Ward Boy of the hospital. The suspension of the Ward Boy substantiates the
fact that he was responsible for the incident. The right to health of the
victim boy has been violated and the Commission considers this a fit case for
award the compensation. Issue notice u/s 18a(i) of the PHR Act, 1993 to the
Chief Secretary, Govt. of Uttar Pradesh directing him to show cause within
four weeks as to why the Commission should not recommend payment of
compensation of Rs. 2,00,000/- to the nine-year old victim boy whose right to
health has been violated.” In response to the Commission’s directions, a
report dated 18.07.2017 has been received from Joint Secretary, Government of
Uttar Pradesh. It is reported that the Department of Medical and Health has
no objection if any compensation is paid to the victim Yash Choudhary @
Aakash Choudhary under the PHR Act, 1993. The Commission, therefore,
recommends the Government of Uttar Pradesh, through the Chief Secretary, to
pay a compensation of Rs. 2 lakh to the victim boy whose human rights were
violated. He will submit Compliance Report along with proof of payment within
four weeks.

The complainant has alleged that
he priest of Rudreshwara Swami Temple assaulted a dalit boy who had gone
there for prasadam. The boy was seriously injured. No FIR was registered by
the police. It has been prayed to register the case under SC/ST (POA) Act 1989
and appropriate action in the matter. Pursuant to the directions of the
Commission, the Superintendent of Police, Bengaluru vide communication dated
28.2.2017 has forwarded the report dated 27.2.2017 of the Dy.SP Nelamangala
which reveals that on 21.10.2014 at about 12.30 hours one Sri Sakubettaiah
appeared in Nelamangala Town PS and lodged complaint stating that his son
Santosh was beaten by priest of temple. He belongs to Scheduled Caste. On
receipt of complaint Nelamangala Town PS case crime No. 266/2014 u/s 323/ 504
IPC and 3 cl(10) (14) SC/ST Act was registered. During investigation accused
Vijay Kumar was arrested and remanded to judicial custody. After completion
of investigation charge-sheet was submitted in the Court. The case was fixed
on 21.4.2017 for hearing before charge. The report further discloses that the
District Commissioner, Bengaluru has sanctioned Rs.25,000/- on 23.10.2014 for
medical expenses and Rs.1,25,000/- on 4.12.2014 as compensation to the
victim. The Commission has considered the above report. The District
Commissioner, Bengaluru (Rural) is directed to submit report within six weeks
about payment of medical expenses and compensation to the victim Santosh s/o
Sakubettaiah along with proof of payment. Let a copy of the proceeding be
sent to the complainant for his information.

People’s
Vigilance Committee on Human Rights (PVCHR) in joint collaboration of
Sangram and Jeevan Jyoti Sansthan, Gaon ke log – a monthly magazine,
Media Vigil, newspaper with Support from United Nation Fund for Torture
Victims is organizing folk school in the support of survivor of torture at Paradkar Smriti Bhawan, Maidagin Varanasi, India on 3rd October, 2017.
The program will be followed with the inauguration of book न्याय स्वतंत्रता समता आजाद भारत में दलित and
the felicitation of Ashish Awasthi, Anoop Shramik and Dhananjay
Tripathi with Jan Mitra Award. In the program the survivors of torture
from Jharkhand and Uttar Pradesh (Barkagaon – Hazaribagh, Ranipur and
Katauna- - Ambedkar Nagar and ChurkNagar – Sonbhadra) will share their
vows as the process of neo – dalit movement for providing a common
platform to the broken people.
