Response from State Legal Service Authority on our interventions



PVCHR intervened to State Legal Service Authority, Lucknow for providing free legal aid to the survivors of torture. We received the response from Shri Subodh Bharti, PCS (J), Assistant Secretary. State Legal Service Authority to produce with the documents of three cases (Sadhu and Aldalat Musahar, Savitri Musahar and Meera Patel) in any working day in the office of the Secretary, District Legal Service Authority.

काशी में यातना पीडितो को सम्मानित कर मनाया गया ईद मिलन

मानवाधिकार जननिगरानी समिति (PVCHR)जनमित्र न्यास व सावित्री बा फूले महिला पंचायत सेंटर फॉर हार्मोनी एंड पीस रिसर्चशांति सद्भावना मंच, ऑल इंडिया सेकुलर फोरमसद्भावना संगमविजन के संयुक्त तत्वाधान में “संघर्षरत यातना पीडितो का सम्मान व शांति सदभाव पर चर्चा किया जाएगा और ईद मिलन समारोह का आयोजन किया गया |
कार्यक्रम की शुरुआत में सबने 2 मिनट का मौन रखकर अलीगढ़ में पिछले दिनों ढाई वर्षीय बच्ची के साथ अमानवीय कृत्य और उसकी निर्मम हत्या पर शोक व्यक्त किया |
कार्यक्रम की रूपरेखा रखते हुए संस्था के संयोजक डा0 लेनिन रघुवंशी ने बताया कि आज समाज में जिसके साथ भी अन्याय होता है वह एकदम हाशिये पर चला जाता है और उसे अपने घरपरिवार और समाज का भी समर्थन न मिलकर उसे दबाने का प्रयास किया जाता है वो भी जब उत्पीड़क पुलिस या राज्य हो ऐसे में हम ऐसे बहादुर पीडितो का सम्मान कर यह सन्देश समाज में देना चाहते है कि लड़ाई अगर संवैधानिक तरीके से लगातार लड़ी जाय तो न्याय अवश्य मिलता है जिसका उदाहरण आज यहाँ इस कार्यक्रम में उपस्थित ये पीड़ित है |जिन्होंने अनेको चुनौतियों के बावजूद भी हिम्मत नहीं हारी और लगातार कानूनी प्रक्रिया के तहत संघर्ष कर अपने आप में एक उदहारण प्रस्तुत किया है ऐसे ही अन्य पीडितो को पूर्व में भी सम्मानित किया जा चूका है जिससे उनके अन्दर एक आत्म विश्वाश बढ़ा है और आज वो एक सामाजिक कार्यकर्ता के रूप में अपने समाज व पीडितो को न्याय दिलाने के संघर्षो में मदद कर रहे है |
इस कार्यक्रम में उपस्थित वक्ता के रूप में सुप्रसिद्ध समाज सेवी – मौलाना हारून रशीद, डा0 मोहम्मद आरिफ, जागृति राही, अनूप श्रमिक, इदरीश अंसारी व श्रुति नागवंशी ने अपने वक्तव्य में कहा कि आज इस कार्यक्रम में सम्मिलित होकर हमें बहुत अच्छा लगा की वर्तमान परिस्थिति में यह सम्मान ऐसे पीडितो को दिया जा रहा है जो लगातार अपने परिवेश और संघर्षो के बावजूद न्याय के लिए लगातार संघर्ष करते रहे है इसके साथ ही यह भी एक बहुत बड़ी बात है कि अपने जैसे पीडितो के लिए ये एक आदर्श उदहारण भी प्रस्तुत कर रहे है 
यह बहुत महत्वपूर्ण है कि ऐसे लोग इतनी यातना और संघर्ष के बाद भी भारत के संविधान और न्याय व्यवस्था में अपना विश्वास रखते है जबकि भारत में आज ऐसा माहौल बना है की व्यक्ति संवैधानिक तरीके से अपनी बात रखता है तो कुछ फासीवादी ताकते उनके ऊपर हमला कर उनकी आवाज को दबाने का प्रयास करते है 

पुलिस यातना के पीडितो को मनो – सामाजिक सम्बल प्रदान करने के लिए उनकी स्व-व्यथा कथा को पढ़ा गया और उनके संघर्षो के लिए उनका हौसला अफजाई के लिए उन्हें सम्मानित किया गया | 
सम्मानित होने के उपरांत वाराणसी से आये पीड़ित सितारा बानो, रितेश यादव, रेहाना बानो, अब्दुल मन्नान, मीरा देवी, महेंद्र मुसहर, कमरजहाँ, मोहम्मद हमीद, गुलाबी, अशोक कुमार पटेल, विनोद राजभर और महेंद्र, जौनपुर से आये पीड़ित रेनू, नगीना और जितेन्द्र कुमार और चंदौली से आई पीडिता जीरा देवी ने भी अपने ऊपर हुए अन्याय को लोगो के समक्ष साझा किया और यह भी बताया कि इस पीड़ा से निकालने के लिए हमें पारिवारिक और सामाजिक स्तर पर कितना संघर्ष करना पड़ा साथ ही यह भी बताया कि न्याय मिलने के बाद एक आत्म संतुष्टि और आत्म विश्वाश जो हमें प्राप्त हुआ उसने पिछले किये गए संघर्षो को एक सुखद क्षण में परिवर्तित कर दिया और यह भी विस्वास बढ़ा की न्याय पाने के प्रक्रिया लम्बी तो हो सकती है लेकिन जीत हमेशा न्याय की ही होती है आज इस कार्यक्रम के द्वारा जो हमें सम्मान प्राप्त हुआ है वो हमारे इरादों को और मजबूती प्रदान करेगा जिससे आगे हमें संघर्ष करने की हिम्मत देता रहेगा साथ ही हम अन्य पीडितो के संघर्षो की लड़ाई में अपना सहयोग देते रहेंगे |
इसके साथ ही कार्यक्रम के अंत में लोगो ने एक दुसरे को सेवई खिलाकर और गले लगाकर ईद की शुभकामनाये दी और काशी की पुरातन साझा संस्कृति और गंगा जमुनी तहजीब की मिसाल पेश की |
इस कार्यक्रम में वाराणसी, जौनपुर और चंदौली से पीडितो के आलावा और भी नागर समाज के सैकड़ो लोग उपस्थित हुए |

Rehabilitation of the rescued bonded labour and 9 ponies

These proceedings are in continuation of the Commission’s earlier proceedings dated 17 January 2019, when it directed as under: “The District Magistrate, Panna, Madhya Pradesh, is directed to send within six weeks a report on the status of rehabilitation of 13 bonded labourers, who were released from the brick kiln in Varanasi, under the provisions of Rehabilitation of Bonded Labourers Scheme, 2016 in addition to immediate financial assistance to the released labourers under the scheme.” In response, the Collector, Panna, Madhya Pradesh, has sent his report dated 06 March 2019, wherein it is stated that eight released bonded labourers out of 12, have been provided Rs. 20,000/- as immediate rehabilitation amount on 25 February 2019. The Commission has considered the report. Issue a reminder to the District Magistrate, Panna, Madhya Pradesh, directing him to send, within six weeks, a report on the status of rehabilitation of 13 bonded labourers, who were released from the brick kiln in Varanasi, under the provisions of Rehabilitation of Bonded Labourers Scheme, 2016 in addition to immediate financial assistance to the released labourers under the scheme.

On the complain of Dr. Lenin Raghuvanshi, Member of District Vigilance Committee, Varanasi 13 bonded labourers and 9 ponies were rescued from NRB marka brick kiln. On 3rd July, 2018 the team comprising SDM Rajatalab, labour department and staffs of PVCHR did joint rescue operation.

PVCHR advocacy on Musahar in Nehiya village

Action Taken:
The matter rested thus when the Commission directed that the State Administration should get a special survey of the entire Musahar community living in the State conducted and include their names in the BPL list, Antodaya list and other lists as per their eligibility. This should be done as a special case and should not be dependent upon exclusion of an equal number of names from the BPL list as per the existing provisions. Similarly, this exercise should also not await publication of the fresh list. State Government shall make out efforts to complete this process of enumeration within a period of three months and report compliance to the Commission by 31st March, 2014. In response, the ADM (Administration), Varanasi, Uttar Pradesh vide communication dated 12.3.2015 submitted that the matter was enquired through District Development Officer, Varanasi, who has informed that in Pindra Block, Varanasi, all the complainants have been provided ration card, identity card and hand pump has been established in Musahar Basti, which is in working order. However, in the general village panchayat so far Lohia Awas have not been given but as soon as the grant is received, the same will also be given to the villagers. The Commission further considered the matter on 27.8.2015 when it observed and directed as under: - “The report has received only in respect of Pindra Block, Varanasi but the Commission on 27.11.2013 has requested the State Government of Uttar Pradesh to make all efforts to get a special survey of the entire Musahar community living in the State of UP conducted and ensure inclusion of their names in the BPL list, Antodaya list and other lists as per their eligibility. The same has not been received. Chief Secretary, Government of UP be asked to order special survey in the light of direction issued by the Commission on 27.11.2013 and response be submitted within eight weeks. Copy of proceedings dated 27.11.2013 be sent to the Chief Secretary, Government of UP for information and action thereon”. In response, the DM, Varanasi, submitted a report dated 20.05.2017 along with a report of Lekhpal dated 16.04.2016, District Supply Officer dated 04.10.2016, District welfare Officer, Varanasi, dated 29.04.2016, BDO Pindra, Varanasi, dated 28.04.2016, Project Director, District Village Development Authority, Varanasi, dated 27.05.2016 and BDO, Pindra, dated 24.05.2016. The report reveals that the different departments of the District have stated that they have taken stock of the Musahar community in the Gram Sabha of Nehiya. The authorities have stated that they have given Musahar community all the benefits under the authorized benevolent scheme of Govt. of India as well as Govt. of UP. The reports have revealed that Musahar community has been given the election card, Antodaya/Ration Card, Old Age Pension and benefits under the scheme of Samajwadi Pension Yojna. The Commission again considered the matter on 20.9.2017 when it observed and directed as under: - “The Commission perused the record and observed that it had directed the Chief Secretary, Govt. of UP, vide its proceedings dated 27.08.2015 to get a special survey of the Musahar community living in the entire State of UP, conducted and ensure inclusion of their names in the BPL list, Antodaya list and other lists as per their eligibility and submit a report within eight weeks. The non-inclusion of the names of the families of Musahar community in the category of very poor and thus denying them the benefits of various social security and social welfare schemes of Centre and the State Government tentamounts to violation of their right to life with dignity, gurarateed under Article 20 of the constitution. Hence, if the suggested survey and the follow up action thereon is delayed any further, the Commission shall take recourse to coercive action u/s 13 of the Protection of Human Rights Act, 1993. However, it appears that the survey has not been conducted, as directed by the Commission. The Commissions, therefore, directs the Chief Secretary, Govt. of UP, to get a survey conducted of the Musahar community living in various districts of UP and submit a report on the points as directed by the Commission in its proceedings dated 27.08.2015 within four months positively”. In response, the Chief Secretary, Government of Uttar Pradesh vide his communication dated 22.1.2018 has submitted a report on constituting a committee for giving benefits under social welfare schemes to the people of Mushahar community in the State. The details of such beneficiaries under certain schemes in four districts of Gorakhpur Zone have also been indicated. The Chief Secretary Government of Uttar Pradesh shall see that the initiatives taken by him are monitored and reviewed periodically. Since the initiative has been taken at the highest level in the State, no further intervention on the part of the Commission is called for and the case is closed.
